Hows it going guys,

I have a 2008 GU VI 3.0L CRD with just under 93,000 on the clock,
So far the vehicle has been into Nissan to have the: exhaust manifold, turbo,tensioner pulley and dash replaced under warranty. At the moment they have the vehicle in for the gearbox that has been grinding when upshifting from 3rd to 4th and downshifting from 5th to 4th. ( sounds like a syncro to me)

Nissan Australia has decided not to cover the repairs under warranty as they believe the damage has occurred by driving the car like a race car and excessive towing.

Firstly has anyone had any dramas with their gearboxes on these models. I am trying to workout if this is a common problem so I can argue my point with Nissan.

I am heading down to the contractor that has the box to have a look for myself, before the fight begins.

I will update this space as I hear more.

Mine use to grind when shifting from 3d to 4th, especially when under load at high revs. Changing to the right oil solved that problem.

I think the 93000 kms is the reason they are jacking up. Mind you, its their responsibility to prove you were abusive. Unless your on youtube laying tramtracks on the streets of dandenong, I think they have a tough time.

I would also like to know what defines excessive towing..

I have an on road camper trailer that weighs in at about 700Kg. The worst place I have towed it is forestry tracks to get into campsites.



RJHUG you would think that but they have decided not to repair or replace.

I have seen many car companies try and ping driver habbits on damage to vehicals and in some cases its related. But the law is that you have payed for a product (your warranty) and the onus is on them as to why they should not supply it too you.

Excessive towing is an oppinion not fact(show me in the manual where it refers to excessive towing and how its defined)

Driving like a race car again is oppinion. What exactly is driving like a racecar??

They have to document evidence - wrong oil, after market shocks, etc. Unless you have had new tyres, pads and clutch, its all here say.

That is why i'm going down to view the box as it helps if i know exactly what the problem is when i take my fight to Nissan. If I had driven the car like an idiot or tried towing outside of the what it had been built for I would completely understand and take it on the chin but seeing as the vehicle is driven sensibly and the amount of warranty work that has already been undertaken I will be fighting this to the end.

You dont need to fight but simply ask the authority refusing warranty to put their reasoning (with references to legislation/owners manual) and what the problem is on a Nissan letterhead with someone signature.

watch them back peddle at a billion miles an hour.

Get smart not tough. ;)

I will definitely take that approach, I'm heading down there tomorrow to speak with the service manager and I will go from there.

What Benno said... start getting all the evidence in writing and try and be nice to your Dealer and keep him on your side... he's the meat in the sandwich.

Essentially he has to get approval from Nissan to pay for the repairs so he has to be convincing 'cause if Nissan say "No" he just shrugs his shoulders and he doesn't get any money for fixing it and you have a poo fight on your hands.

Uuuuummm... I assume you have had the vehicle since new? Was it serviced by Nissan franchises?

The trucks towing capacity is 2500Kgs !!!!! How can a 700Kg Camper trailer be considered excessive????? Do you tow it all of the time?? Still should not be an issue.
A Navara is rated to tow 3000Kgs.....

I tow probably 50% of the time and have towed excessive loads with patrols with up to 350,000Kms on the clock and not had gearbag or clutch problems.

Tell them to detail their opinion in writing.

Yeah I got the vehicle new in 08 from the the Nissan dealer in Windsor Qld since then it has been looked after by dealerships in NT WA and VIC.
Cheers I did get a bit sh#@y at the service manager today after he told me they need the car longer than the week they told me. Lucky for me the 85 MK shorty is bulletproof.

Not related to the gearbox, but a customer of ours has had his 08 GU into Nissan twice now for the turbo mainfold gasket, and we have replaced the hydraulic tensioner for him once, with Nissan also doing so. The same vehicle has also been through a set of hubs already (40,000km), and the owner considers dirt roads to be 4WDing... Nissan have been pretty good to him, but the vehicle has spendt more time on a tow truck than its' own wheels lately...

Cool... good luck with the "fight". Sometimes it all gets really pally when they realise you are willing to duke it out with a Consumer Advocate or Small Claims as well... PIA but hey they should be paying

I feel his pain I am starting to get annoyed. To the most part Ive been looked after by Nissan and the dealerships except when the ignition was fixed and i picked up the car with the steering column still sitting in the passenger seat (that was a dealer stuff up).
